    US Circuit Court Strikes Down Obamacare

    Wait, it is now up to SCOTUS for Obamacare to survive!

    "A federal appeals court struck down a pillar of President Obama's national healthcare law, ruling Congress does not have the power to require all Americans to buy insurance and setting the stage for a Supreme Court decision ahead of the 2012 election.

    The 2-1 decision is a victory for Republican leaders in 26 states who challenged the law last year, testing whether the signature accomplishment of Obama's presidency would stand.

    The Atlanta-based judges echoed the complaint that the mandate represents an "unprecedented" expansion of federal power."

    Did you read the decision? No, because that would require you to put forth effort. Do you understand the US Constitution? No, because then you would able to distinguish between taxes and the Interstate Commerce Clause.

    Health insurance is not interstate commerce, it is intra-State commerce, and Congress has no power to regulate intra-State commerce.

    Also, an amendment provides for taxation.

    The majority-opinion used powerful language too, which is seldom used in appeals-decisions. 'Breathtaking in scope'... The Supreme Court will hear the case this Autumn and release their final ruling during the height of the Presidential-campaign.

    You are ignoring the 2 Federal District Court judges who previously ruled on this issue. That is the basis of appeal to the 11Th Circuit. SCOTUS will hear any appeal from Obama and his minions. If you bothered to read the OP carefully you would have noticed I did not predict an outcome from SCOTUS.

    Well! The SCOTUS finally does something right. Let's face facts, Obummercare IS economic armageddon for this country. It has been proven time and time again, socialized medicine is insane! Tax the rich (everyone's employer) to pay for it? Insane again! They (the rich, the liberal's favorite scapegoat) already pay the vast majority of taxes anyway and they are so taxed now that they can't afford to produce any more jobs! The problem with socialism is that you soon run out of everyone else's money and then NOBODY has any to show for it.

    It has not reached SCOTUS yet. There is another Federal Circuit Court ruling due soon.

    I think funding of the government is one thing... having the government on any level dictate what you need to buy and basically be involved in what you are charged is indeed unconstitutional. If a State government wants to dictate it on its citizens, it is not right, but that is perhaps fine by the state constitution. Having the fed government do such is clearly not constitutional, and really is not a valid point to compare with taxation.

    No. I think OD was referring-to the '10 State Of The Union Speech, when Obama singled-out the Court in front of Congress/the Nation, attempting to embarrassingly politicize them over some false-flag silliness about SCOTUS allowing private campaign-donations from overseas... while 'the One' completely ignored overseas donations to Unions, whose money was then donated-to campaigns.

    It was The Prez who ended-up looking silly the next day, but he never apologized to the Court.

    The Prez's new strategy on the campaign trail is to get everybody angry at Congress for bickering as the cause of all our economic and otherwise woes.

    All the stories about his two recent appearances in public kept saying something along the lines of "President Obama, talking like he means business with his shirtsleeves rolled up, came out swinging."

    Over and over the other day there is was- watch for it- the President, talking tough and meaning business, with his shirtsleeves rolled up, trying to garner populist anger at Congress for not compromising enough to pass his agenda. I just loved that whole emphasis on an Obama who came out of the fray battle-hardened and ready to Fight!

    Well anyway- Reef's statement above- yeah I guess he'll also attack the courts, too. The WH seems all the more ready these days to attack the very checks and balances a President is supposed to have, so that they do not get too big for their britches.
